AL: Jefferson County debt holders file questions in challenge to largest U.S. government bankruptcy

BIRMINGHAM, Alabama -- A bank representing Jefferson County debt holders and lawyers who successfully challenged the county's 2009 occupational tax have filed their proposed questions to ask the Alabama Supreme Court about the county's right to seek bankruptcy protection.

The submissions were requested by U.S. Bankruptcy Judge Thomas Bennett, as creditors seek to block Jefferson County's Chapter 9 bankruptcy filing over its $4.23 billion in debts, including $3.14 billion for a court-ordered sewer rehabilitation program.

The creditors contend Jefferson County does not have the right under Alabama law to file for bankruptcy, because it did not have any outstanding bond debt. The county has amassed its debt through bond-like debt instruments called warrants.

But the county contends it can legitimately seek Chapter 9 protection because it had issued bonds in the past and commissioners approved a resolution in July contemplating the need for future bond sales.

The lawyers want the bankruptcy judge to ask the Alabama Supreme Court if the county must have outstanding bond debt to file bankruptcy, and what effect past county bond sales or commissioners' stated future plans to sell bonds would have on the county's right to seek protection from creditors.

In a hearing earlier this month, Bennett said he had not decided if he would submit questions to the Alabama Supreme Court on its interpretation of the state government bankruptcy law. Wednesday was the deadline for lawyers to file their proposed questions to the bankruptcy judge.

The state high court currently is considering a similar issue regarding a bankruptcy petition filed by the south Alabama town of Prichard. A bankruptcy judge rejected Prichard's petition because it had outstanding warrant debt but no bond debt, and the town filed an appeal to the state Supreme Court.

3 miners rescued from Tenn. mine after fire (AP)

NEW MARKET, Tenn. ? A fire broke out inside a zinc mine in Tennessee on Wednesday, trapping three miners inside for about three hours before they were rescued, authorities said. Two other miners below ground were injured by smoke inhalation.

The three miners were trapped by smoke and needed respirators before they could leave the mine. A rescue team helped them out and they appeared unharmed, though they were taken to a hospital as a precaution, said Tim Wilder of the Jefferson County EMA.

"They looked about as good as expected for being underground for three hours," he said.

Wilder said the miners had been in contact with authorities by couldn't leave because the smoke was so thick. "It's the ending you hope for," he said.

Renata Roberts, a spokeswoman for Switzerland-based mine operator Nyrstar, said the three rescued miners were "in fine spirits."

"We are working with mine safety officials and others to make sure it's safe to resume operations. We are undertaking a full investigation," Roberts said.

There were 54 miners underground at the time of the fire, according to Amy Louviere, a spokeswoman with the Mine Safety and Health Administration.

It was not clear yet how the fire started on a drill rig about 800 feet below ground around 1:10 p.m. EST.

The Young Mine is about 25 miles northeast of Knoxville.

According to MSHA records, Nyrstar has been operating the mine since 2006 and has had six operator injuries this year and seven operator injuries last year. Most were minor, according to descriptions of the incidents available on the MSHA website.

In November, a truck bed hit a high voltage cable causing a power outage in part of the mine. The mine was evacuated until power was restored about two hours later.

The mine had an average of about 99 miners working underground in the third quarter of 2011.

Cow power - Energy project to transform cow manure into green energy

King County Executive Dow Constantine joined local dairy farmers in Enumclaw to celebrate the beginning of construction on a digester project that will transform cow manure into green energy and other valuable resources.

?The robust agriculture industry on the Enumclaw Plateau is the perfect place for this innovation that will generate renewable energy, save money for family farmers, and preserve the environment,? said Executive Constantine.

Rainier Biogas LLC, a partnership between Skagit County-based company Farm Power Northwest, and at least three local dairies near Enumclaw, will build and operate the digester. The digester is an air-tight tank that uses microorganisms to break down or ?digest? the manure and organic matter. The bacteria produce waste gas that can be harnessed to make electricity. Construction on the $4 million project is scheduled to be completed in summer 2012.

Manure waste management on dairy farms is a significant operational challenge for farmers because of its volume and handling expense. Improperly managed manure can pollute water bodies.

Processing manure over three weeks in a 1-million-gallon digester vessel, Rainier Biogas will generate enough electricity to power 600 typical homes.

The elimination of manure lagoon methane emissions combined with clean electricity will reduce net greenhouse gas emissions by the equivalent of 9,000 tons of CO2 per year, which is the equivalent of removing 2,200 cars from the road.

In addition, the treatment process separates digested straw from the processed manure, creating a source of cow bedding as well as a soil amendment to nourish fields that grow feed, saving farmers thousands of dollars a month in operational expenses.

Employees with King County?s Water and Land Resources and Wastewater Treatment divisions served as technical advisors related to agricultural sustainability and resource recovery, though the majority of the $492,000 King County has committed to the project came from federal grants appropriated by?? Senator Maria Cantwell and Representative Dave Reichert.

The groundbreaking celebration was also attended by Washington State Director of the USDA?s Office of Rural Development, Mario Villanueva; representatives from Puget Sound Energy, One Pacific Coast Bank, Washington State University and the Andgar Corporation.

Icahn goes hostile with Commercial Metals bid (Reuters)

(Reuters) ? Billionaire investor Carl Icahn went hostile with his bid to buy Commercial Metals Co (CMC.N) on Tuesday, a day after the metals recycler rejected his $1.73 billion offer.

Icahn said he will stick with his original bid price of $15 a share for the tender offer, despite the company terming the offer as low.

"After attempting to work with the board, we are launching this tender offer so that shareholders can decide for themselves what they wish to do with their company," Icahn said in a statement.

On Monday, Commercial Metals had urged its shareholders to vote against Icahn's bid, which requires stockholder approval to authorize, adopt or amend any rights plan.

The company had adopted a shareholders' rights plan in July to prevent Icahn from increasing his near-10 percent stake in the company.

Shares of the company were trading marginally up at $14.18 on Tuesday on the New York Stock Exchange.

They had lost about a third of their value this year before Icahn unveiled his bid last week. The stock has failed to touch the $15 offer price so far.

Stepping in dog poop is annoying, but the health hazard is unknowingly ingesting or contact with the poop.

While walking around Chicago, I came across this sign that is unique in its clarity: Pet waste transmits disease (right, exactly as shown).

It goes straight to the point and informs the public of the real reason behind the need to clean after our pets in public places.

Dog poop can spread hookworms and roundworms, both of which can infect humans and have severe consequences: ocular larva migraines from roundworms; cutaneous larva migraines from hookworms.

But Farrah was not to be denied! She concluded her rant with: "Guess what! Age and money honestly do not change a person's poor choice. Quit making excuses."

GMAC ends most Mass. mortgage lending after suit (AP)

NEW YORK ? One day after it was among five major banks sued by Massachusetts over deceptive foreclosure practices, GMAC Mortgage says it will stop purchasing new mortgage loans written by third parties in the state.

The mortgage origination and servicing arm of Ally Financial Inc. says it will honor all commitments with correspondent lenders and wholesale brokers through Monday.

GMAC will continue to lend directly to homeowners in Massachusetts. Most of its business in the state is done through third parties like community banks, which originate loans and sell them to GMAC.

GMAC then handles the loan servicing, or collecting homeowner payments.

The suit claims GMAC and other banks violated Massachusetts law with "unlawful and deceptive" conduct, including unlawful foreclosures, false documentation, robo-signing, and deceptive practices related to loan modifications.

Merkel says "marathon" crisis will take years to solve (Reuters)

BERLIN (Reuters) ? The euro zone debt crisis cannot be solved overnight, German Chancellor Angela Merkel said on Friday, urging instead a long-term approach that relies on tougher fiscal rules being enshrined in European treaties.

A week before European leaders meet in Brussels for what is being seen as a make-or-break summit for the 13-year-old single currency bloc, Merkel once again rejected the idea of joint euro zone bonds and cautioned against steps that might hurt the credibility of the European Central Bank.

"The government has made clear that the European debt crisis can't be solved in one fell swoop overnight. There is no miracle solution. There is no easy, rapid solution," Merkel told parliament. "Resolving the sovereign debt crisis is a process and this process will take years."

She is under growing pressure to take bolder steps to resolve a crisis that has spread like a virus from Greece, Portugal and Ireland to the very core of Europe, raising questions about whether the bloc can survive intact.

Merkel likened the battle to contain the crisis to a marathon, warning Europe against speeding from the start line with measures that would come back to haunt it before the finish line was reached.

"Marathon runners often say that the run becomes especially difficult at the 35 kilometer mark, but they also say that reaching the finish line is possible if you are conscious of the full challenge from the very start and approach it accordingly," Merkel told lawmakers in the Bundestag lower house.

"The one who starts fastest isn't necessarily the most successful. It is the one who is aware of what is involved in running the full distance."

Merkel spoke a day after French President Nicolas Sarkozy backed her push for stricter coordination of national budgets but warned against handing over control to a supra-national body in Brussels. "The reform of Europe is not a march towards supra-nationality," Sarkozy said in the French city of Toulon.

EURO BONDS "POINTLESS"

Merkel called joint euro bonds "pointless" and said people who were calling for them as a remedy have "not understood the nature of the crisis".

Criticizing politicians for failing to ensure the bloc's fiscal rules, enshrined in the Stability and Growth Pact, she said there was no alternative but to agree new tougher guidelines and set them in stone.

"There is no way around changing the European treaties, or as a second-best option agreeing new treaties. We are going to Brussels with the target of pushing through treaty changes. That is with the spirit of wanting to avoid a division of euro countries and non-euro member states."

Frank-Walter Steinmeier, parliamentary leader for the opposition Social Democrats (SPD), slammed Merkel's handling of the crisis in a speech to the Bundestag after she spoke.

"No one, Frau Merkel, blames you for the crisis. But how you've handled it is a scandal," said Steinmeier, who lost to Merkel in a 2009 election.

"In daylight hours you criticize those European countries that want to ECB to come to the rescue. When it turns dark, you pray that the ECB will continue to buy up bonds."
